Legal guardian

«Tutor»


As the appointment of a legal guardian is the exclusive duty of the court, you can not make the appointment directly yourself but your choice will have preference in the order of nominees. The person of your choice will be appointed by the court unless it is clear that this is not to the benefit of the minor.

Please take into account that if one of the parents passes away the guardianship remains with the surviving parent.

If a «tutor» ( legal guardian) is designated in the last will of both parents, both wills will be observed if possible. If not, the court will appoint a guardian who appears to be the best choice under the current circumstances and for the benefit of the minor.
